Specific services, timelines, and deliverables are defined in individual proposals, agreements, or service descriptions.

2. No Guarantees

While we use industry best practices and professional experience, we do not guarantee specific results, including but not limited to rankings, traffic levels, lead volume, sales, or revenue.

Marketing results depend on many factors outside our control, including market conditions, competition, client responsiveness, and platform changes.

3. Client Responsibilities

You agree to:

• Provide accurate and complete information

• Respond promptly to requests needed to deliver services

• Maintain ownership or authorization for all content, domains, and accounts provided

• Ensure compliance with applicable laws, regulations, and platform policies related to your business

Delays or failures caused by lack of client cooperation are not the responsibility of Rocket Up Marketing.

4. Payments & Billing

• Fees are outlined in your proposal, invoice, or service agreement

• Setup fees and monthly fees are non-refundable unless otherwise stated in writing

• Payments are due according to invoice terms

• Late or failed payments may result in paused or terminated services

• Subscription-based services may renew automatically unless canceled in writing

All prices are subject to change with notice.

5. Cancellations & Termination

• Month-to-month services may be canceled with written notice (typically 30 days unless otherwise stated)

• Setup fees are non-refundable once work has begun

• Early termination of contracted terms does not entitle the client to refunds

• Rocket Up Marketing reserves the right to terminate services for non-payment, misuse, abuse, or violations of these Terms

6. Intellectual Property

• All original materials created by Rocket Up Marketing remain our intellectual property until full payment is received

• Upon payment, clients receive a limited license to use deliverables for their business purposes

• We reserve the right to showcase work in our portfolio unless otherwise agreed in writing

• Clients warrant that any materials they provide do not infringe on third-party rights

7. Third-Party Platforms & Tools

We may use third-party tools and platforms (including CRM, hosting, email/SMS, analytics, and ad platforms).

Rocket Up Marketing is not responsible for:

• Platform outages or changes

• Policy enforcement by third-party providers

• Data loss or service interruptions caused by third parties

Use of these tools may also be subject to separate terms from those providers.

8. Limitation of Liability

To the fullest extent permitted by law:

• Rocket Up Marketing shall not be liable for indirect, incidental, consequential, or special damages

• Our total liability shall not exceed the amount paid to us for services in the prior 30 days

• We are not responsible for lost profits, lost data, or business interruption

9. Indemnification

You agree to indemnify and hold harmless Rocket Up Marketing from any claims, damages, liabilities, or expenses arising from:

• Your business operations

• Content you provide

• Violations of laws or third-party rights

• Use or misuse of our services

10. Compliance with Laws

Clients are solely responsible for ensuring their business, marketing, messaging, and data collection comply with applicable laws and regulations, including but not limited to:

• CAN-SPAM

• TCPA

• Data privacy and advertising regulations

Rocket Up Marketing does not provide legal advice.

11. Confidentiality

Both parties agree to keep confidential information private unless disclosure is required by law or authorized in writing.

12. Website Use

You agree not to:

• Misuse the website or services

• Attempt unauthorized access

• Upload malicious code

• Copy or redistribute website content without permission

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

14. Changes to Terms

We may update these Terms from time to time. Continued use of our website or services constitutes acceptance of updated Terms.
